1.2 Headings are for convenience only and do not affect interpretation. Words in the singular include the plural and vice versa. "Including" means "including without limitation". A reference to a law includes any amendment or re-enactment of it.
1.3 These Terms are an electronic record within the meaning of the Information Technology Act, 2000 and the rules made under it. They are generated by a computer system and do not require any physical or digital signature. They are published in accordance with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, to the extent applicable.
2.1 You may use the Service only if you are at least 18 years of age and competent to contract under the Indian Contract Act, 1872.
2.2 The Service is intended for advocates, law firms, legal professionals, law students, litigants and others who need assistance with legal documents. If you use the Service on behalf of a firm, company or other organisation, you represent that you are authorised to bind it to these Terms, and "you" includes that organisation.
2.3 You represent that all information you provide is true, accurate, current and complete, and you agree to keep it updated.
2.4 We may refuse registration, or restrict access to any feature, at our discretion, including where required by Applicable Law.
3.1 You must keep your sign-in credentials and any device used to access the Service secure and confidential. You are responsible for all activity under your Account, whether or not authorised by you, until you notify us of unauthorised use.
3.2 An Account is personal and may be used by one person only. You must not share, sell, transfer or permit others to use your Account.
3.3 Free Allowances are limited to one Account per person, per verified mobile number and per organisation. Creating multiple Accounts, using false identities or any other method to obtain additional free use is prohibited and may result in suspension of all related Accounts and forfeiture of Credits.
3.4 You must notify us immediately at [SUPPORT EMAIL] of any unauthorised use of your Account or any security breach. We are not liable for any loss arising from your failure to keep your credentials secure.
4.1 The Service provides software tools, including reading of scanned and typed documents, translation of documents between Indian languages and English, editing, case briefs and summaries, PDF and Word utilities, and links to or information from official court websites. Features may differ between free and paid use and may change from time to time.
4.2 The Service is a technology tool only. LawDaftar is not a law firm, does not provide legal advice or legal services, and does not practise law. No advocate-client, fiduciary or professional relationship is created between you and us by your use of the Service.
4.3 Nothing in the Service is, or is intended to be, solicitation or advertisement of any advocate or law firm within the meaning of the Bar Council of India Rules.
4.4 Court board, cause list and similar information is obtained from official court websites and third-party sources that we do not control. It may be delayed, incomplete, inaccurate or unavailable. Alerts and notifications may be late or may not arrive at all. Never rely on the Service for your appearance in court. You must verify all such information from the official source or in court before relying on it.
4.6 Features marked "Beta" or "preview" are offered for trial and may change or stop without notice.
4.5 We may add, modify, suspend or discontinue any feature, language, tool or part of the Service at any time. Where reasonably practicable and where a change materially reduces a paid feature you have already paid for, we will give notice and, at our option, offer a reasonable alternative or a pro-rata refund of unused Credits.
5.1 Output is generated by automated systems, including artificial intelligence. Output may contain errors, omissions, mistranslations, incorrect names, dates, numbers, sections, citations or facts, and may not reflect the meaning, legal effect or nuance of the original.
5.2 Items marked "Verify", "Review", "unreadable", "uncertain" or similar are flagged for your attention, but the absence of a flag does not mean an item is correct.
5.3 You are solely responsible for reviewing every Output against the original document, and for any use you make of Output, including filing it before any court, tribunal or authority, serving it on any party, advising any client or relying on it in any matter. You must apply your own professional judgement at all times.
5.4 Where a certified, sworn or official translation is required by any court, authority or law, the Output is not a substitute for it.
5.5 We do not guarantee that any Output will be accepted by any court, registry, authority or person.
5.6 Any translator's certificate, declaration or attestation added to an Output is made, signed and owned by the person who signs it. LawDaftar does not certify, attest or vouch for any Output.
6.1 You retain all rights, title and interest in your User Content. We claim no ownership of it.
6.2 You grant us and our service providers a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit, process, translate, analyse and display your User Content and Output only to the extent necessary to provide, secure and support the Service for you, and to comply with Applicable Law. This licence ends when the User Content is deleted, subject to clause 6.5.
6.3 We do not use your User Content or Output to train artificial intelligence models, and we do not sell it.
6.4 You represent and warrant that: (a) you own or have all rights, consents, permissions and authority needed to upload the User Content and to have it processed as described in these Terms and the Privacy Policy, including the consent of any client or other person whose personal data it contains, where required; (b) your User Content and its processing do not infringe any intellectual property, privacy, confidentiality or other right of any person, or breach any court order, professional obligation or Applicable Law; and (c) your User Content does not contain malware or harmful code.
6.5 User Content and Output are deleted automatically 30 days after upload, or earlier if you delete them. Deleted material may persist in encrypted backups for a limited period before permanent removal, as described in the Privacy Policy. You are responsible for downloading and keeping copies of anything you need before deletion. We are not a storage, archival or record-keeping service and are not liable for any loss of User Content or Output.
6.6 We may remove or disable access to any User Content that we reasonably believe breaches these Terms or Applicable Law, or as required by a court order or a lawful direction of a government authority.
7.1 We treat your User Content as confidential and access it only as described in the Privacy Policy, including when you ask us for support, when needed to secure the Service, or when required by Applicable Law.
7.2 Our collection and use of personal data is governed by the Privacy Policy, which forms part of these Terms. To the extent your User Content contains personal data of other persons, you are the data fiduciary for that personal data under the Digital Personal Data Protection Act, 2023 and we process it on your behalf to provide the Service.
7.3 If any User Content may not lawfully, or under your professional obligations, be processed as described in the Privacy Policy, you must not upload it.
8.1 You must not, and must not permit anyone to: (a) use the Service for any unlawful, fraudulent or malicious purpose, or in breach of any court order or professional rule; (b) upload content that is obscene, defamatory, threatening, harassing, hateful, or that infringes any person's rights, or any other content prohibited by Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021; (c) attempt to gain unauthorised access to the Service, other Accounts, our systems or any data not belonging to you; (d) probe, scan or test the vulnerability of the Service, or breach any security or authentication measure; (e) introduce viruses, malware or any harmful code; (f) overload, flood or disrupt the Service, or interfere with other Users; (g) use any robot, scraper, crawler or automated means to access the Service or extract data, except as expressly permitted by us in writing; (h) copy, modify, reverse engineer, decompile or create derivative works of the Service or its software, except as permitted by law; (i) resell, sublicense, rent or commercially exploit the Service or Output as a service to third parties without our written consent; (j) remove or obscure any notice, label or disclaimer in the Service; (k) circumvent any usage limit, Free Allowance limit or payment requirement; or (l) impersonate any person or misrepresent your identity, enrolment or affiliation.
8.2 We may monitor the Service for security, misuse and breach of these Terms (without reading the contents of your documents), investigate any suspected breach, suspend an Account at once where we reasonably suspect misuse, and co-operate with law enforcement authorities as required by Applicable Law.
9.1 The Service, including its software, design, text, graphics, logos, the name and mark "LawDaftar", and all related intellectual property rights, are owned by or licensed to us and are protected by Applicable Law. Except for the limited right to use the Service under these Terms, no right, title or licence is granted to you.
9.2 Subject to these Terms and payment of applicable fees, you may use Output for your own professional and personal purposes. We make no representation that Output is free from third-party rights, including in the underlying source documents.
9.3 If you send us feedback or suggestions, we may use them without restriction or obligation to you.
10.1 New Accounts may receive a one-time Free Allowance (currently 3 translation pages and 1 case brief for a file of up to 20 pages). The Free Allowance has no cash value, cannot be transferred and may be changed or withdrawn by us for new Accounts at any time.
10.2 Further use of paid features requires Credits purchased in advance. Prices are shown before purchase and are [INCLUSIVE / EXCLUSIVE] of GST and other applicable taxes, as stated at the time of purchase.
10.3 Credits are deducted when paid work starts. Usage, Credits and payments as recorded by the Service are prima facie evidence of your use and balance. The same unchanged page is not charged twice within its retention period. If paid work fails because of a fault in the Service, the Credits used will be restored as described in the Refund and Cancellation Policy.
10.4 Credits [EXPIRE AFTER ___ MONTHS FROM PURCHASE / DO NOT EXPIRE]. Credits have no cash value, are not legal tender, cannot be transferred between Accounts, and are refundable only as stated in the Refund and Cancellation Policy.
10.5 Payments are processed by a third-party payment provider. We do not store your card, UPI or bank details. Your use of the payment provider is subject to its own terms.
10.6 We may change prices for future purchases at any time. Changes do not affect Credits already purchased.
10.7 You are responsible for all charges levied by your bank, card issuer or payment provider.
11.1 The Service relies on third-party services, including hosting, storage, document-processing, sign-in and payment providers and official court websites. Their availability and performance are outside our control, and their use may be subject to their own terms and policies.
11.2 Links to third-party websites, including court websites, are provided for convenience only. We do not endorse and are not responsible for their content, accuracy or availability.
12.1 We aim to keep the Service available and reliable but do not guarantee that it will be uninterrupted, timely, secure or error-free. The Service may be unavailable during maintenance, updates, failures of third-party services or events beyond our control.
12.2 Support is provided by email at [SUPPORT EMAIL] during [SUPPORT HOURS]. Response times are not guaranteed.
13.1 To the maximum extent permitted by Applicable Law, the Service and all Output are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied or statutory, including any warranty of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, non-infringement, or that the Service will meet your requirements.
13.2 No advice or information, whether oral or written, obtained from us or through the Service creates any warranty not expressly stated in these Terms.
13.3 Nothing in these Terms excludes any right you have as a consumer that cannot lawfully be excluded under the Consumer Protection Act, 2019 or other Applicable Law.
14.1 To the maximum extent permitted by Applicable Law, we, our proprietors, directors, employees, agents and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, clients, goodwill, data, opportunity, or any adverse outcome of any legal proceeding, arising out of or in connection with the Service or Output, however caused, even if advised of the possibility of such loss.
14.2 Without limiting clause 14.1, we are not liable for any loss arising from: (a) your reliance on Output that you did not independently verify; (b) errors in source documents, court data or third-party services; (c) deletion of User Content in accordance with these Terms; (d) unauthorised access to your Account caused by your failure to keep it secure; (e) any missed hearing, deadline, limitation period or appearance, any adverse order, any claim by your client or any professional or disciplinary proceeding, arising from your use of the Service or Output; or (f) any event beyond our reasonable control.

14.4 Nothing in these Terms limits liability that cannot be limited under Applicable Law, including liability for fraud.
15.1 You agree to indemnify, defend and hold harmless us, our proprietors, directors, employees, agents and service providers from and against all claims, demands, proceedings, losses, damages, penalties, costs and expenses (including reasonable legal fees) arising out of or relating to: (a) your User Content; (b) your use of the Service or Output; (c) your breach of these Terms or Applicable Law; or (d) your infringement of any right of any third party, including your clients.

19.1 These Terms and any dispute arising out of or in connection with them are governed by the laws of India.
19.2 The parties shall first attempt in good faith to resolve any dispute through the grievance process in clause 17, for a period of 30 days.
